Licensing Terms

License Agreement

This license is a legal agreement between you and HTTP VINEBRANCHES LLC, a Texas (USA) Limited Liability Corporation, herafter referred to as Vine Branches, for the use of Vine Type. By downloading Vine Type or any Vine Type modules, you agree to be bound by the terms and conditions of this license. Vine Branches reserves the right to alter this agreement at any time, for any reason, without notice.

PERMITTED USE

Non-Commercial License holders may use, free of charge, Vine Type on a website engaging in personal, non-commercial, and/or non-profit activities. Commercial License holders may use Vine Type on a website engaging a commercial, or for-profit activities. Websites engaging in direct, or indirect commercial activities must purchase a Commercial License. Vine Branches will be the sole arbiter as to what constitutes commercial activities.

The presence of Google AdWords ads on a Vine Type website shall not be considered commercial use.

For commercial-uses of Vine Type, a purchased license is required for each installed instance of Vine Type. One license grants the right to one installation. Each additional installation of Vine Type requires an additional purchased license. An installation is defined as a single instance of the Vine Type executable code (dll) file.

LICENSE RESTRICTIONS

Unless you have been granted prior, written consent from Vine Branches, YOU MAY NOT:

• Reproduce, distribute, or transfer Vine Type executable code files, or portions thereof, to any third party.
• Alter any Vine Type computer executable code.
• Sell, rent, lease, assign, or sublet the software, or portions thereof.
• Grant rights to any other person.
• Use Vine Type software in violation of any U.S. or international law or regulation.

DISPLAY OF COPYRIGHT NOTICES

All copyright and proprietary notices associated with this product must remain intact. Non-commercial license holders are required to display a visible, functioning "powered by Vine Type" (link to http://vinetype.com) text link on every page that relies on the Vine Type dll to display the page. Text size of the "Powered by Vine Type" link shall be no smaller than 90% the size of the text used as the site's consumable content text size. Commercial license holders are exempt from the visible link requirement.

Copyrights of fonts included with Vine Type remain with their owners and you are bound by the terms provided with those fonts.

SOFTWARE MODIFICATION

You may alter, modify, or extend the non-executable portions of Vine Type for your own use, or commission a third-party to perform modifications for you, but you may not resell, redistribute or transfer the modified or derivative version without prior written consent from Vine Branches. Furthermore, components from Vine Type software may not be extracted and used in other programs without prior written consent from Vine Branches.

Technical support is available on an as-available basis. Vine Branches does not guarantee direct email or phone support. REFUNDS

Due to the non-returnable nature of downloadable software, Vine Branches does not issue refunds once a transaction has been completed. All software offered by Vine Branches is available for evaluation prior to purchasing as a free download. We encourage you to thoroughly test the system you are interested in before purchasing to determine its suitability for your purposes and compatibility with your hosting account.

INDEMNITY

You agree to indemnify and hold harmless Vine Branches and/or any of its affiliates or assigns for any third-party claims, actions or suits, as well as any related expenses, liabilities, damages, settlements, fees, trauma, or emotional distresss arising from your use or misuse of the software, or a violation of any terms of this license.

DISCLAIMER OF WARRANTY

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF QUALITY, PERFORMANCE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. FURTHER, VINE BRANCHES DOES NOT WARRANT THAT THE SOFTWARE OR ANY RELATED SERVICE WILL ALWAYS BE AVAILABLE.

LIMITATIONS OF LIABILITY

YOU ASSUME ALL RISK ASSOCIATED WITH THE INSTALLATION AND USE OF THE SOFTWARE. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS OF THE SOFTWARE BE LIABLE FOR CLAIMS, DAMAGES OR OTHER LIABILITY ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE. LICENSE HOLDERS ARE SOLELY RESPONSIBLE FOR DETERMINING THE APPROPRIATENESS OF USE AND ASSUME ALL RISKS ASSOCIATED WITH ITS USE, INCLUDING BUT NOT LIMITED TO THE RISKS OF PROGRAM ERRORS, DAMAGE TO EQUIPMENT, LOSS OF DATA OR SOFTWARE PROGRAMS, OR UNAVAILABILITY OR INTERRUPTION OF OPERATIONS.
